The science as it stands right now:
1. The vax does not diminish viral loads nor spread. Consequently there is no difference in this regard between the vaxed and unvaxed.
2. The vax does not diminish illness. Insofar as preventing severe illness and death, this is not true in the older age groups (60 and above) and in those with co-morbidities.
3. The incidence of Covid in the under 30 age group is minimal and does not warrant the vax when weighed up against rising vax-induced adverse reactions and death.
4. Natural immunity is far superior than vax immunity in terms of comprehensiveness and durability. Vax effectiveness wanes at 4 -6 months requiring endless boosters. Herd immunity cannot be attained with the vax alone.
Labour Legality as applied to the Republic of South Africa:
Extract from the Bill of Rights of the Constitution of the Republic of South Africa, Section 22:
“Freedom of trade, occupation and profession
Every citizen has the right to choose their trade, occupation or profession freely. The practice of a trade, occupation or profession may be regulated by law.”
Clearly an individual who complies with the statutory requirements of a profession or the prescribed requirements of employment may not be hindered in this endeavour by any other person or body as long as they are lawfully engaged in their occupation. As has been shown in the aforementioned discussion, there is no basis in science for the promulgation of restrictive laws that would disallow Covid unvaccinated individuals access to their place of work, travel or any normal social intercourse. Such action would indeed challenge the relevant section of the Bill of Rights and would clearly violate the constitutionality of the individual.
Discussion:
There is no justification for the dismissal of unvaxed individuals based on the sciences. This is most applicable to those who have recovered from a previous Covid infection and who demonstrate appropriate post-infection antibodies. Dismissal on this basis is consequently in violation of universal labour law since it is not supported by science nor the rational interpretation thereof. Additionally, since the science has now documented the increasing post-vax adverse reactions and awareness has been created thereof, an employer who coerces an employee into accepting the vax as a condition for employment is obliged to accept full responsibility for post-vax adverse reactions should they occur.
